DMCA Policy

This Digital Millennium Copyright Act Policy ("Policy") applies to the upoomand platform, accessible at upoomand.info, and describes how upoomand responds to claims of copyright infringement submitted in accordance with the Digital Millennium Copyright Act ("DMCA").

1. Respect for Intellectual Property

upoomand respects the intellectual property rights of others and expects users of our platform to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws.

2. Reporting Copyright Infringement

If you believe that content available on or through upoomand infringes one or more of your copyrights, please submit a written notification ("Takedown Notice") containing the information described below to our designated copyright agent.

2.1 Required Information for a Takedown Notice

To be effective under the DMCA, your Takedown Notice must include all of the following:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the copyright that has allegedly been infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the platform (such as the URL or specific page location).
  4. Information reasonably sufficient to permit us to contact you, including your full name, postal address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Our Response to Takedown Notices

Upon receipt of a valid and complete Takedown Notice, upoomand will act expeditiously to:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the content that it has been removed or disabled.
  • Provide the user with a copy of the Takedown Notice, where appropriate.

upoomand reserves the right to remove content that appears to infringe third-party intellectual property rights without prior notice, at our sole discretion.

4. Counter-Notice Procedure

If you believe that material you posted was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notice ("Counter-Notice") to our copyright agent. To be effective, your Counter-Notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your full name, postal address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of a competent court and that you will accept service of process from the person who provided the original Takedown Notice or an agent of such person.

Upon receipt of a valid Counter-Notice, upoomand will forward it to the original complainant. If the complainant does not notify us within fourteen (14) business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material at our discretion.

5. Repeat Infringers

It is upoomand's policy, in appropriate circumstances, to terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or whose content has been removed from the platform more than twice.

6. Misrepresentation

Please be aware that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. If you are uncertain whether content you wish to report constitutes copyright infringement, we recommend consulting a qualified legal professional before submitting a notice.

7. Modifications to This Policy

upoomand reserves the right to modify this Policy at any time. Changes will be reflected by updating the "Last Updated" date at the top of this page. Your continued use of the platform following any such modification constitutes your acceptance of the revised Policy.
